AI Terms of Use

These AI Terms of Use ("AI Terms") supplement and form an integral part of the Locabee Terms of Service. They govern your use of all artificial intelligence and machine learning features available on the Locabee Platform (the "AI Features"). By using any AI Feature, you agree to these AI Terms. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. AI Features Overview

1.1 Available AI Features

The Platform provides AI-powered capabilities including, but not limited to:

  • Content Generation — Social media captions, marketing copy, content calendars, and blog drafts
  • Image Generation — Promotional and social media images based on your preferences
  • Image Analysis — Automated tagging, categorization, and visual intelligence for your gallery
  • Smart Search — Intelligent content and image discovery
  • Smart Suggestions — Context-aware content ideas and recommendations
  • Draft Review — Automated quality assessment of generated content

We may add, modify, or discontinue AI Features at any time. New AI Features are subject to these AI Terms unless separate terms are provided.

1.2 Credit Consumption

AI Features consume Credits based on the type and complexity of operations. Current Credit costs are displayed before each operation. See the Terms of Service (Section 5.3) and Refund Policy for Credit-related terms.

2. Third-Party Providers

2.1 Use of Third-Party Services

Our AI Features rely on third-party artificial intelligence service providers. Your use of AI Features is subject to the acceptable use policies of these providers. Locabee reserves the right to refuse, limit, or terminate AI Feature access if usage violates provider terms or applicable law.

2.2 Provider Changes

We may change, add, or replace AI providers at any time to improve quality, maintain service, reduce costs, or ensure compliance. Provider changes do not affect your rights under these AI Terms.

3. Input and Output Ownership

3.1 Your Input

"Input" means any data, text, images, prompts, or other material you provide to AI Features. You retain all rights to your Input. By submitting Input, you grant Locabee a limited license to process it through AI Features solely to provide the Service to you.

3.2 Your Output

"Output" means any content generated by AI Features based on your Input. Subject to the limitations below, you own the Output generated for your use and may use it for any lawful purpose, including commercial use.

3.3 Output Limitations

  • Non-Exclusivity: Similar or identical Output may be generated for other users. We do not guarantee uniqueness.
  • No Guarantee of IP Protection: AI-generated Output may not qualify for copyright protection in all jurisdictions. The legal status of AI-generated content is evolving.
  • Third-Party Rights: We cannot guarantee that Output does not infringe third-party rights. You are responsible for verifying this before use.

3.4 How We Use Your Data

  • Locabee does not use your Input or Output to train general-purpose AI models
  • Your Input and Output are processed solely to deliver the Service to you
  • Anonymized, aggregated usage patterns may be used to improve the Service

4. Acceptable Use

4.1 Permitted Uses

You may use AI Features to generate marketing content, visual assets, content ideas, and other materials for your business as intended by the Platform.

4.2 Prohibited Uses

You must not use AI Features to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Create content that infringes intellectual property rights
  • Generate deepfakes, non-consensual intimate imagery, or content impersonating real individuals without authorization
  • Create content that constitutes or promotes fraud, deception, or scams
  • Generate spam, bulk unsolicited messages, or misleading advertising
  • Produce content that promotes violence, discrimination, hate speech, or terrorism
  • Generate medical, legal, financial, or professional advice intended to substitute qualified professional counsel
  • Create content designed to mislead consumers about products or services
  • Circumvent safety filters, content policies, or usage restrictions
  • Reverse-engineer, extract, or attempt to derive any underlying technology, models, or proprietary information
  • Use AI Features to build competing products or services
  • Systematically extract AI-generated Output for purposes unrelated to your use of the Platform
  • Input third-party personal data without a valid legal basis

4.3 Industry-Specific Obligations

If you operate in a regulated industry, you are solely responsible for ensuring AI-generated content complies with your industry's regulations, including but not limited to:

  • Truth-in-advertising laws (including UWG in Germany and the EU Unfair Commercial Practices Directive 2005/29/EC)
  • Health claims regulations (EU Regulation 1924/2006)
  • Professional conduct and licensing requirements

5. Limitations and Disclaimers

5.1 No Guarantee of Accuracy

AI-generated content is provided on an "as is" basis. AI may produce inaccurate, incomplete, biased, or inconsistent content. Locabee does not warrant the accuracy, reliability, completeness, or fitness for any purpose of any AI Output.

5.2 Your Responsibility

You are solely responsible for:

  • Reviewing and editing all AI-generated content before publishing or distributing it
  • Ensuring AI-generated content complies with applicable laws and regulations
  • Verifying that AI-generated images do not inadvertently resemble real individuals, trademarks, or copyrighted works
  • Disclosing AI-generated content where required by law or platform policies
  • Any consequences arising from the use of AI-generated content

5.3 EU AI Act Compliance

In accordance with the EU AI Act (Regulation (EU) 2024/1689):

  • Locabee's AI Features are classified as limited-risk AI systems
  • Where AI-generated content could reasonably be mistaken for human-created content, we encourage you to label it as AI-generated
  • AI-generated images include metadata indicating AI generation where technically feasible

5.4 Country-Specific Provisions

For German users (Verbraucher): AI-generated advertising content must comply with the UWG truth-in-advertising standards and applicable DDG transparency requirements. Liability for AI-generated content is limited as described in the Terms of Service Section 14.3.

For Austrian users: AI-generated advertising content must not be misleading under the UWG (§ 2). KSchG consumer protection provisions apply to consumer-facing AI-generated communications.

6. Data Processing

When you use AI Features, business-level data (such as service descriptions, brand settings, and content prompts) may be processed by our third-party providers. Your personal data from CRM, financial information, passwords, and private messages are never sent to AI providers.

Some of our AI providers are located outside the EU/EEA. International transfers are protected by appropriate safeguards as described in our Privacy Policy and Data Processing Agreement.

7. Service Availability and Credit Refunds

7.1 Availability

AI Features depend on third-party provider availability. We do not guarantee uninterrupted access. Maintenance, outages, or capacity limits may temporarily affect availability.

7.2 Automatic Credit Refunds

If an AI operation fails due to a system error, the Credits consumed will be automatically refunded within 24 hours. See our Refund Policy for details.

7.3 Quality Expectations

Credits are not refunded for Output that does not meet subjective expectations, requires editing, or for repeated generation attempts. Contact support for persistent quality issues.

8. Modifications

We may update these AI Terms to reflect changes in technology, new features, changes in applicable law, or updates to provider terms. Material changes will be communicated in accordance with the Terms of Service Section 1.4.

9. Termination of Access

We may suspend or terminate your access to AI Features if you violate these AI Terms, engage in prohibited uses, or if required by applicable law. This does not automatically affect your overall Platform account unless the violation also breaches the Terms of Service.
